Entre indemnit\u00e9, allocation ou cong\u00e9s pay\u00e9s, divers points doivent \u00eatre bien consid\u00e9r\u00e9s par les p\u00e8res. En g\u00e9n\u00e9ral, <strong>on peut d\u00e9terminer le lien de paternit\u00e9 de trois mani\u00e8res<\/strong>\u00a0:<\/p>\n<ul>\n<li>L\u2019\u00e9poux de la m\u00e8re est indiqu\u00e9 comme p\u00e8re l\u00e9gal d\u2019un enfant n\u00e9 durant la dur\u00e9e du mariage.<\/li>\n<li>Le lien de filiation peut \u00eatre d\u00e9fini par un tribunal si la m\u00e8re intente une action en paternit\u00e9.<\/li>\n<li>Le lien de paternit\u00e9 peut \u00eatre d\u00e9termin\u00e9 par reconnaissance. Cela peut \u00eatre possible soit gr\u00e2ce \u00e0 une d\u00e9claration devant l\u2019officier d\u2019\u00e9tat civil du p\u00e8re, par testament ou par l\u2019interm\u00e9diaire d\u2019une proc\u00e9dure judiciaire.<\/li>\n<\/ul>\n<p>Ainsi, qu\u2019importe la mani\u00e8re d\u2019\u00e9tablir le lien de filiation, le p\u00e8re de l\u2019enfant peut b\u00e9n\u00e9ficier d\u2019un cong\u00e9 de paternit\u00e9. N\u00e9anmoins, ce lien doit \u00eatre d\u00e9fini <strong>dans les six mois suivant la naissance de l\u2019enfant<\/strong>. Le p\u00e8re peut disposer de son cong\u00e9 postnatal <strong>sous forme de semaines ou de journ\u00e9es individuelles<\/strong>. Par contre, il ne peut pas prendre des demi-journ\u00e9es de cong\u00e9. De plus, l\u2019int\u00e9gralit\u00e9 des jours de cong\u00e9 doit \u00eatre prise dans les 6 mois apr\u00e8s la naissance de l\u2019enfant.<\/p>\n<p>Ainsi, les jours de cong\u00e9 qui n\u2019ont pas \u00e9t\u00e9 utilis\u00e9s dans ce temps imparti seront perdus. \u00c0 noter toutefois que la loi ne d\u00e9termine pas le droit du p\u00e8re d\u2019imposer les jours de son cong\u00e9 paternit\u00e9 \u00e0 son employeur. Il est donc recommand\u00e9 pour les deux parties de convenir ensemble sur les dates de cong\u00e9. Ceci permet de consid\u00e9rer non seulement les int\u00e9r\u00eats du salari\u00e9 ainsi que de l\u2019entreprise.<\/p>\n<p>En ce qui concerne l\u2019indemnit\u00e9, le week-end est indemnis\u00e9 comme dans le cas du cong\u00e9 de maternit\u00e9. Le p\u00e8re dispose ainsi de 14 indemnit\u00e9s journali\u00e8res.<\/p>\n<p>Cependant, les indemnit\u00e9s peuvent \u00eatre b\u00e9n\u00e9fici\u00e9es selon la forme de cong\u00e9\u00a0:<\/p>\n<ul>\n<li>Le p\u00e8re touche 7 indemnit\u00e9s journali\u00e8res par semaine dans le cas o\u00f9 le cong\u00e9 est pris par semaine.<\/li>\n<li>Le p\u00e8re touche 7 indemnit\u00e9s journali\u00e8res pour 5 jours dans le cas o\u00f9 le cong\u00e9 est pris sous forme de journ\u00e9es individuelles.<\/li>\n<\/ul>\n<p>Pour ceux qui exercent une activit\u00e9 professionnelle \u00e0 temps-partiel, ils ont droit \u00e0 10 jours de cong\u00e9 selon le taux d\u2019occupation. Une demande aupr\u00e8s de la caisse de compensation comp\u00e9tente est effectivement n\u00e9cessaire.<\/p>\n<p><strong>L\u2019allocation est pay\u00e9e \u00e0 l\u2019employeur<\/strong> si ce dernier continue de verser le salaire \u00e0 la personne concern\u00e9e. Ainsi, d\u00e8s le deuxi\u00e8me\u00a0employeur, le salari\u00e9 doit compl\u00e9ter une fiche compl\u00e9mentaire pour chaque employeur suppl\u00e9mentaire.
