Il est \u00e9galement possible d&rsquo;accorder un 13e mois de salaire.<\/p>\n<p class=\"textLayer\">Mais si un tel contrat est garanti, <strong>il doit \u00eatre pay\u00e9 en toutes circonstances.<\/strong>\u00a0Qu&rsquo;il s&rsquo;agisse d&rsquo;un contrat de travail individuel ou d&rsquo;une convention collective n&rsquo;est pas pertinent. En outre, il existe le cas particulier de la modification tacite du contrat.<\/p>\n<p class=\"textLayer\">Ce cas peut se pr\u00e9senter lorsque l&#8217;employeur verse r\u00e9guli\u00e8rement un 13e salaire sur une longue p\u00e9riode. Le salaire est vers\u00e9 \u00e0 partir du 13e mois. On peut alors consid\u00e9rer qu&rsquo;il y a eu ici une modification tacite du contrat en faveur de l&#8217;employ\u00e9, ce qui permet d&rsquo;\u00e9tablir un contrat de travail droit l\u00e9gal na\u00eet.<\/p>\n<p class=\"textLayer\">La somme du 13e mois de salaire peut th\u00e9oriquement \u00eatre n\u00e9goci\u00e9e\u00a0librement, mais elle <strong>est g\u00e9n\u00e9ralement calcul\u00e9e sur la base du salaire mensuel brut,<\/strong> puis multipli\u00e9e \u00e0 un certain taux (souvent 100%) par le nombre de mois d&rsquo;appartenance \u00e0 l&rsquo;entreprise (en g\u00e9n\u00e9ral douze), la somme annuelle \u00e9tant ensuite divis\u00e9e par douze, de sorte que vous recevez 1\/12 du revenu annuel brut.<\/p>\n<p>Si vous n&rsquo;avez pas travaill\u00e9 dans l&rsquo;entreprise pendant les douze mois complets de l&rsquo; ann\u00e9e fiscale (exercice), le paiement vous revient au prorata de votre anciennet\u00e9, par exemple \u00e0 50% si vous avez travaill\u00e9 six mois dans l&rsquo;entreprise.<\/p>\n<p>Toutefois, d&rsquo;autres dispositions peuvent \u00eatre prises par contrat. <strong>Voici comment\u00a0calculer<\/strong><strong>,<\/strong> \u00e0 titre d&rsquo;exemple, pour fixer la somme du 13e salaire dans un cas normal : Salaire annuel brut (par exemple 12000 CHF) divis\u00e9 par les mois d&rsquo;anciennet\u00e9 (par exemple douze) \u00e9quivaut \u00e0 un 13e mois de salaire de 1000 CHF.<\/p>\n<p>Il est important de noter <strong>que les heures <\/strong><strong>suppl\u00e9mentaires effectu\u00e9es ne doivent pas <\/strong><strong>\u00eatre factur\u00e9es<\/strong>, la base de calcul \u00e9tant le temps de travail r\u00e9glementaire selon le contrat de travail.<\/p>\n<p>En r\u00e8gle g\u00e9n\u00e9rale, les employ\u00e9s qui n&rsquo;ont pas convenu d&rsquo;un salaire mensuel fixe dans leur contrat de travail, mais qui sont pay\u00e9s \u00e0 l&rsquo;heure, ne sont pas concern\u00e9s par le versement d&rsquo;un 13e salaire.
